The operating agreement.

These Terms of Service (“Terms”) are an agreement between you and Accelara AI Solutions Limited, a private company registered in the Dubai International Financial Centre and trading as Accelara AI Solutions, as operator of the SendOperator service (“SendOperator,” “we,” “us,” or “our”). By accepting an invitation, creating an account, or using SendOperator, you agree to these Terms and our Privacy Policy.

You must be able to form a binding contract and, if using SendOperator for an organization, have authority to bind that organization.

SendOperator helps users prepare audiences and email copy, connect sending mailboxes, review suggested secondary domains, approve managed domain access, require approval before launch, schedule approved outreach, and organize replies. Features may change during the private beta.

If managed sending is available to your workspace, SendOperator presents an exact quote before purchase. The quote identifies the proposed domains, the one-time amount due, and the fixed 12-month service term. Availability can change until registration completes. If an approved domain becomes unavailable, a replacement requires a new approval.

• Nothing is purchased merely because SendOperator generated a suggestion. Purchase begins only after an authorized workspace member approves the displayed scope and payment is confirmed.
• SendOperator is the registrant and DNS administrator. You receive a limited right to use the approved domains through SendOperator for the displayed term. The domains are not sold to you and are not transferable.
• You must not select a name that impersonates another organization or violates trademark or other rights.
• The one-time card payment is captured when checkout completes. If SendOperator cannot fulfill the exact approved order, including where only some domains register, SendOperator automatically refunds the full customer payment. Any domains already registered remain controlled by SendOperator and are not transferred. Domains do not auto-renew. Any additional term requires a new offer and explicit payment.
• This purchase does not include mailbox hosting, warm-up, a sending ramp, or any deliverability or campaign-result guarantee.

We may pause purchasing, provisioning, renewal, or sending when payment fails, required information is missing, a provider reports abuse or risk, or continuing would threaten recipients, infrastructure, or the service. A human decision appears in SendOperator when one can resolve the issue.

• Provide accurate account and workspace information.
• Protect passwords, invitations, API keys, and connected-account access, and promptly report suspected compromise.
• Use each account only as authorized and keep workspace roles current.
• Accept responsibility for activity performed through your account unless you notified us of unauthorized use without unreasonable delay.

You are responsible for your campaigns and must:

• Have a lawful basis and any permission required to contact each recipient and process their information.
• Use truthful sender identity, subject lines, claims, and contact information; do not impersonate another person or organization.
• Provide the workspace’s real physical mailing address and preserve SendOperator’s unsubscribe mechanism in commercial messages.
• Honor opt-outs, suppression records, bounces, provider policies, and applicable marketing, privacy, consumer-protection, and anti-spam law.
• Review audiences, variables, attachments, schedules, and every email presented at an approval gate before approving launch.

You may not use SendOperator to:

• Send unlawful, fraudulent, deceptive, abusive, or harassing content.
• Distribute malware, phishing, credential theft, or content that infringes another person’s rights.
• Evade opt-outs, mailbox-provider limits, technical safeguards, sending caps, rate limits, or access controls.
• Probe, disrupt, reverse engineer, resell, or provide unauthorized access to the service except where applicable law expressly permits.
• Upload information you are not entitled to use or use sensitive personal information for discriminatory or harmful targeting.

We may pause sending, disconnect a mailbox, or suspend access when reasonably necessary to protect recipients, providers, the service, or other users.

AI-generated plans, classifications, summaries, and drafts can be incomplete or wrong. They are suggestions, not legal, compliance, deliverability, or professional advice. You must review output before relying on it or approving a send.

You may provide corrections and instructions to improve a workspace’s output. SendOperator does not promise that generated content will be unique or that a campaign will produce replies, revenue, or inbox placement.

You retain ownership of content you submit. You grant SendOperator a limited right to host, copy, process, transmit, and display that content only as needed to provide, secure, support, and improve the service as described in the Privacy Policy.

You represent that you have the rights needed for the content and data you provide. Feedback about SendOperator may be used without restriction or compensation, provided it does not identify confidential workspace data.

SendOperator relies on services such as Google, OpenAI, Supabase, Vercel, payment processors, registrars, DNS operators, and mailbox providers. Your use of a connected service remains subject to its terms and limits. We are not responsible for a third party changing, restricting, suspending, or ending its service or your account.

You may revoke connected-account access, but doing so can stop sending, reply synchronization, or other dependent features.

SendOperator is currently a private beta. Features may be incomplete, unavailable, or changed without a service-level commitment. We may set usage limits and may discontinue a beta feature or the beta itself.

When a paid plan or managed setup is available, we disclose the price and applicable billing terms before charging you. You authorize the displayed one-time charges when you approve checkout. Taxes may be added when required. Failed or reversed payments may pause provisioning, renewal, or service. You remain responsible for charges incurred directly with providers you connect yourself.

You may stop using SendOperator at any time and may request workspace deletion. We may suspend or terminate access for material breach, security risk, unlawful activity, provider-policy violations, harm to recipients or service reputation, or discontinuation of the service.

Ending SendOperator does not erase accrued fees or require domain transfer. The full-refund promise in Section 3 applies when SendOperator cannot fulfill the exact approved order; it does not apply merely because you later choose to stop using a fulfilled service. Platform-managed domains remain registered to and controlled by SendOperator and expire at the end of the paid service term unless a new term is explicitly offered and bought.

Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and accrued obligations—continue after termination.

To the fullest extent permitted by law, SendOperator is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, deliverability, or specific campaign results.

To the fullest extent permitted by law, SendOperator and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Aggregate liability arising from the service will not exceed the greater of US$100 or the fees you paid for SendOperator during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law prohibits them.

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Dubai International Financial Centre. The DIFC Courts have exclusive jurisdiction over disputes arising out of or in connection with these Terms or the service.

Nothing in this section removes a protection or remedy that applicable law does not permit the parties to exclude, including any mandatory consumer protection that applies to you.

We may update these Terms as the service changes. We will provide appropriate notice of material changes. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
